Whilst the Office of Fair Trading failed in their test case against banks on Unfair Bank Charges, it has been indicated by Lord Philips that charges may be challenged under Regulations 5 & 8 of the Unfair Terms in Consumer Regulations 1999.
Since the outcome of the Office of Fair Trading’s test case, the waiver imposed by the Financial Ombudsmen Service has now lifted, which means that complaints made to banks on unfair charges must be dealt with within 8 weeks of submission.
